Governing access to and use of the NewSigma Platform

Important Notice

These Terms of Service ("Terms") are a legally binding agreement between you and NewSigma Technologies Private Limited ("NewSigma", "we", "us", or "our"). They govern your access to and use of the NewSigma mobile application, website at newsigma.in, and related services (collectively, the "Platform"). By creating an account, accessing, or using the Platform, you agree to these Terms and the policies expressly incorporated into them. If you do not agree, do not use the Platform.

These Terms should be read together with the Privacy Policy, Community Guidelines, Meme Creator & Reward Guidelines, Grievance Redressal Policy, Refund & Cancellation Policy, Copyright and Intellectual-Property Reporting Policy, Cookie Policy, and any additional rules presented for a specific feature or programme. Where a feature-specific policy conflicts with these Terms, the feature-specific policy will apply only to that feature and only to the extent of the conflict, unless applicable law requires otherwise.

1. Eligibility and Acceptance

1.1 Eligibility

You may use NewSigma only if you are legally permitted to use the Platform and are capable of forming a binding agreement with NewSigma or, where applicable, are otherwise legally permitted to access or use the Platform subject to any consent, authorization or other requirements imposed by applicable law.

Your access to any part of the Platform is subject to applicable law and any age, consent, authorization or other requirements that apply to you or to the particular feature you use. By using NewSigma, you represent that the information you provide about your age and eligibility, where requested, is accurate.

Certain features, programmes, transactions, promotions or rewards may carry additional age, consent, identity, payment or eligibility requirements. NewSigma may restrict access to a particular feature or take other reasonable measures where required by applicable law, platform-safety requirements or the rules of that feature. Where we learn or reasonably suspect that an account or feature is being used in breach of an applicable age or consent requirement, we may restrict, suspend or permanently close the relevant account or feature access and take appropriate steps regarding associated information, subject to applicable law and lawful retention requirements.

1.2 Acceptance

You accept these Terms by creating an account, accessing the Platform, or using any Platform feature. If you use the Platform on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" includes that entity.

1.3 Availability and Local law

NewSigma is operated by NewSigma Technologies Private Limited from India and may be made available to users in India and other jurisdictions. If you access or use the Platform from outside India, you are responsible for ensuring that your access to and use of the Platform complies with the laws applicable to you in that jurisdiction. NewSigma may restrict or modify access to the Platform or particular features in certain jurisdictions where required by applicable law.

2. Accounts and Account Security

• Provide accurate, complete and reasonably current information when creating and maintaining your account.
• Keep your authentication credentials confidential and do not sell, rent, lend, lease, transfer or otherwise provide your account to another person without NewSigma's written permission.
• Promptly notify NewSigma if you believe your account or credentials have been compromised or used without authorization.
• Do not create multiple accounts to manipulate engagement, Danks, rankings, Weekly Sigma, rewards, moderation, Prior Publication, or other Platform systems.
• Do not create or use an account to evade a suspension, restriction, reward disqualification, moderation decision or other enforcement action.

3. The Platform

NewSigma is a social-content Platform consisting primarily of two sections:

• News — platform-generated news and current-affairs content, including General News and IAS News.
• Sigma — a user-generated space where users create and share image and video memes, including standalone memes and memes associated with NewSigma News or external links.

NewSigma may introduce or discontinue features, including recommendations, rankings, Context, Prior Publication, Weekly Sigma, Meme Creator recognition and merchandise rewards. We may modify, suspend, replace or discontinue Platform features subject to applicable law and any notice obligations that apply.

4. News and IAS Content

News content may include summaries, analyses, background information, current-affairs coverage and educational material based wholly or partly on third-party sources. News content may be prepared with automated or machine-assisted systems and may be reviewed through editorial processes.

NewSigma strives to provide useful, timely and accurate information but does not guarantee that News content will always be complete, current, accurate, error-free, unbiased, or continuously available. Third-party reporting may later be corrected, updated, withdrawn, or become unavailable.

IAS-related material is provided for general information and educational purposes. It is not professional, legal, financial, investment, medical or other professional advice and does not guarantee any examination result, rank, selection or other outcome. Users should verify important information against official sources.

5. User Content

5.1 Ownership

You retain ownership of original content that you create and post on NewSigma ("User Content"), subject to third-party rights and the licence granted below. User Content may include memes, images, videos, captions, comments, Context information, Prior Publication materials and other submissions.

5.2 Licence to NewSigma

When you submit User Content, you grant NewSigma a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, cache, reproduce, format, adapt where reasonably necessary for Platform functionality, publish, display, communicate, distribute, transmit, analyse and otherwise use that User Content for operating, providing, maintaining, securing, improving and promoting the Platform and its services. NewSigma does not acquire ownership of your User Content merely because of this licence.

The licence continues for as long as reasonably necessary for the purposes above and for residual, backup, moderation, legal, security, dispute-resolution, fraud-prevention, competition-integrity or historical records that NewSigma is entitled or required to retain.

5.3 Public Content

User Content that you intentionally make publicly available on NewSigma is "Public Content". Public Content may be viewed, copied, shared, downloaded, indexed, quoted, embedded or otherwise interacted with by other users and may continue to appear in feeds, search, recommendations, rankings, compilations, previews or other Platform surfaces.

By making User Content public, you authorize NewSigma to display, distribute and promote that Public Content as part of the Platform, subject to applicable law and these Terms. You remain the owner of your original Public Content, subject to third-party rights.

5.4 Your representations

• You have the rights, permissions, licences or other lawful basis necessary to submit the User Content and grant the rights described in these Terms.
• You will not knowingly submit content that infringes copyright, trademark, patent, privacy, publicity, contractual or other rights.
• You are responsible for the content you submit and for the consequences of unlawful or misleading submissions.

5.5 NewSigma's rights regarding User Content

NewSigma may review, remove, restrict, label, limit distribution of, disable access to, or otherwise take action regarding User Content where permitted or required by these Terms, the Community Guidelines, applicable law, lawful orders, valid complaints, platform-integrity requirements, or safety considerations.

6. Context and Prior Publication

6.1 Context

NewSigma may allow users to associate a meme with an existing NewSigma News item, external web link or other relevant context ("Context"). Context is not required for every meme. You must not use Context to deliberately mislead users, attach content to an unrelated News item to create a false impression, misrepresent an external link, or present fabricated information as genuine reporting.

6.2 Prior Publication

NewSigma may provide a mechanism through which users can report that a meme was publicly published elsewhere before its NewSigma submission ("Prior Publication"). A claim should include reasonably accurate evidence. Knowingly false, fabricated, malicious or abusive claims may result in enforcement action.

A verified Prior Publication finding may affect Weekly Sigma eligibility, rankings, recognition, rewards or other programme benefits. NewSigma may retain investigation records for safety, dispute resolution, competition integrity, legal compliance and Platform integrity.

7. Community Rules and Prohibited Conduct

You must comply with these Terms, the Community Guidelines, applicable law and all feature-specific policies. You must not use NewSigma to host, upload, publish, modify, transmit, store, share or otherwise disseminate content or conduct that is unlawful, prohibited or materially deceptive.

• Content that unlawfully belongs to another person or is shared without the necessary rights.
• Obscene, pornographic, sexually explicit, exploitative, privacy-invasive, hateful, harassing, threatening, defamatory or otherwise unlawful content.
• Content involving child sexual abuse or exploitation, or any content that sexualizes or exploits minors.
• Fraud, phishing, malware, malicious code, unlawful schemes, spam, scams or deceptive commercial conduct.
• Content that impersonates a person or entity or materially misrepresents identity, affiliation or authority.
• Knowingly false or materially misleading information presented as fact, including deceptive manipulation of Context.
• Threats or incitement relating to violence or criminal conduct, or other prohibited unlawful activity.
• Artificial or coordinated manipulation of Danks, likes, views, comments, shares, rankings, Weekly Sigma or rewards.
• Scraping, crawling, bulk extraction, harvesting or automated indexing except through expressly permitted functionality or written permission.
• Attempts to bypass technical, moderation, access-control or security measures.
• Use of the Platform to facilitate unlawful gambling, money laundering, financial fraud or similar prohibited activity.

8. Moderation, Safety and Enforcement

NewSigma may use reports, automated tools, human review, technical signals and other methods to detect spam, abuse, fraud, manipulation, security incidents and policy violations. No automated system is guaranteed to be error-free.

• Remove or restrict content;
• Label or alter presentation of content;
• Limit reach or distribution;
• Disable comments or other interactions;
• Exclude content or engagement from Weekly Sigma and reward calculations;
• Suspend or restrict particular features;
• Suspend or restrict accounts;
• Permanently close accounts; and
• Take other actions permitted or required by applicable law.

Where applicable, appeals may be available through NewSigma's grievance or appeal processes. The fact that NewSigma does not immediately act on a particular report does not waive its rights to act later.

9. Synthetic, Manipulated and AI-Assisted Content

NewSigma may permit or host content created or modified using generative AI or other computational tools. You must not use such tools to create or share unlawful, deceptive, privacy-invasive, sexually exploitative, fraudulent or materially misleading content. Where applicable to the technology and law governing a feature, NewSigma may require prominent disclosure or labelling of synthetically generated information and may deploy technical provenance or other safeguards.

10. Weekly Sigma and Meme Creator Rewards

Weekly Sigma and Meme Creator programmes are governed by the Meme Creator & Reward Guidelines. Participation does not guarantee recognition or a reward. Merchandise rewards are subject to the applicable Danks threshold and other eligibility conditions described in those Guidelines. NewSigma may exclude invalid, manipulated, fraudulent, duplicated or otherwise ineligible engagement or content and may correct rankings or outcomes.

Merchandise rewards are programme benefits and not purchases. Unless expressly stated otherwise, rewards have no cash value and are not exchangeable for cash. Reward eligibility may depend on compliance with these Terms, the Community Guidelines, Prior Publication requirements and programme-specific rules.

11. Intellectual Property and Copyright

NewSigma-owned software, technology, interface, design, trademarks, logos, branding, editorial compilations and NewSigma-created materials are owned by or licensed to NewSigma and protected by applicable intellectual-property laws. Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, lease, publicly display or reverse-engineer them.

Third-party material, including News sources and material referenced or linked through User Content, remains subject to the rights of its respective owners. Copyright and other intellectual-property complaints may be submitted through the Copyright and Intellectual-Property Reporting Policy.

12. Third-Party Content, Links and Services

The Platform may contain links to, embedded material from, or integrations with third-party websites, services or content. NewSigma does not control independent third parties and is not responsible for their availability, accuracy, security, privacy practices, terms or activities. Your use of third-party services is governed by the applicable third party's terms and policies.

Content shared to a third-party service may remain on that service even after deletion from NewSigma, subject to the third party's policies.

13. Paid Features, Subscriptions and Merchandise

Certain features, services or merchandise may be offered for purchase. Applicable prices, taxes, billing periods, delivery charges and material purchase terms will be presented before checkout. Purchases are also subject to the Refund & Cancellation Policy and, where applicable, app-store or payment-provider rules.

14. Account Deactivation and Permanent Deletion

14.1 Deactivation

Users may deactivate their NewSigma account through the designated account settings.

Upon deactivation, the account will become inactive and the user's displayed identity will be anonymized. For example, a username such as w*username may be displayed as w*deactivated.

Public contributions previously made by the user, including memes, comments and other contributions, will not be deleted solely because the account has been deactivated.

14.2 30-Day Reactivation Period

Following deactivation, the user will have 30 days to log in and reactivate the account.

If the user logs in during this period, the account may be reactivated subject to NewSigma's applicable procedures.

14.3 Permanent Deletion

If the user does not reactivate the account within 30 days, the account will be permanently deleted.

Following permanent deletion, the user's displayed identity associated with historical public contributions may be changed from w*deactivated to w*deleted.

Public contributions may remain available on NewSigma unless subsequently removed under NewSigma's policies, applicable law, or other valid reasons.

NewSigma may retain historical records, moderation records, Prior Publication records, competition records, security records and other information that it is entitled or required to retain under the Privacy Policy or applicable law.

Personal and account-identifying information that NewSigma is no longer required or permitted to retain will be deleted or anonymized in accordance with the Privacy Policy and applicable law.

A permanently deleted account cannot be restored. A former user who wishes to use NewSigma again must create a new account and satisfy the eligibility requirements applicable at that time.

15. Disclaimers

To the maximum extent permitted by law, the Platform is provided on an "as is" and "as available" basis. NewSigma does not guarantee that the Platform will be uninterrupted, secure, error-free, accurate or permanently available, or that particular News, rankings, recommendations, features, rewards or User Content will remain available.

Nothing in these Terms excludes or limits any liability, warranty, statutory right, consumer protection or remedy that cannot lawfully be excluded or limited.

16. Limitation of Liability

To the maximum extent permitted by applicable law, NewSigma Technologies Private Limited and its directors, officers, employees, affiliates, agents, contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profits, revenue, goodwill, business opportunities or data, arising from or related to the Platform.

Subject to applicable law, NewSigma's aggregate liability for claims arising out of or relating to the Platform or these Terms during any twelve-month period will not exceed the greater of INR 1,000 or the amount you paid directly to NewSigma for the Platform during that twelve-month period. This limitation does not apply to liability that cannot lawfully be limited.

17. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless NewSigma Technologies Private Limited and its directors, officers, employees, affiliates, agents, contractors and service providers from claims, liabilities, losses, damages, costs and reasonable legal expenses arising from your breach of these Terms or Platform policies, your unlawful conduct, your User Content, your Context or Prior Publication submissions, your infringement of third-party rights, or your unauthorized use of the Platform.

18. Grievances and Appeals

Complaints about User Content, moderation, accounts, Prior Publication, Weekly Sigma, rewards, payments, privacy or other Platform matters may be submitted through the Grievance Redressal Policy. NewSigma will handle grievances in accordance with applicable law and the procedures stated in that Policy.

19. Suspension and Termination

NewSigma may suspend, restrict or permanently close an account or feature where reasonably necessary or permitted because of policy violations, fraud, manipulation, abuse, serious or repeated misconduct, attempts to evade enforcement, threats to user or Platform safety, legal or regulatory requirements, or a lawful order. Where required by law or applicable procedure, NewSigma may provide notice and/or an opportunity to appeal.

Provisions concerning User Content, intellectual property, disclaimers, liability, indemnification, disputes, historical records and other provisions that by their nature should survive will continue after termination.

20. Changes to the Platform and these Terms

NewSigma may add, remove, modify, suspend or discontinue features, content categories, rankings, programmes or other aspects of the Platform. We may revise these Terms to reflect Platform changes, business practices or applicable law. Where required, material changes will be communicated through the Platform, email or another appropriate method. The revised Terms will show an updated date. Continued use after the effective date constitutes acceptance to the extent permitted by law.

21. Governing Law and Jurisdiction

These Terms and your relationship with NewSigma are governed by the laws of India, without regard to conflict-of-law principles, except to the extent that mandatory provisions of the law applicable to you require otherwise.

Subject to applicable law, disputes arising out of or relating to these Terms or your use of the Platform will be subject to the jurisdiction of the competent courts at the location of NewSigma's registered office in India.

Nothing in this Section limits any mandatory consumer protection, statutory right, remedy, or jurisdiction that cannot lawfully be excluded or waived under the law applicable to you.

22. Informal Resolution of Disputes

Before starting formal proceedings, users are encouraged to contact NewSigma at [email protected] with a written description of the issue and the resolution sought. NewSigma will make reasonable efforts to review the matter. This informal process does not restrict any statutory right or remedy.

23. General Provisions

• Entire agreement: These Terms and the expressly incorporated policies form the agreement concerning use of the Platform.
• Severability: If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue.
• No waiver: Failure to enforce a provision does not waive the right to enforce it later.
• Assignment: You may not assign these Terms without NewSigma's prior written consent. NewSigma may assign them in connection with a merger, acquisition, restructuring or transfer of the business, subject to applicable law.
• Force majeure: NewSigma is not responsible for delay or failure caused by circumstances beyond reasonable control, subject to applicable law.
• No partnership or agency: These Terms do not create a partnership, employment, agency or joint venture between you and NewSigma.
• Feedback: Suggestions and feedback may be used by NewSigma without compensation or confidentiality obligations unless otherwise agreed in writing.

24. Compliance with Applicable Intermediary Requirements

To the extent NewSigma is subject to applicable intermediary, digital-media, consumer, data-protection, intellectual-property or other platform-specific legal requirements, NewSigma will maintain and publish the policies, grievance mechanisms, disclosures and processes required by applicable law.

Where applicable law requires NewSigma to periodically inform users about the consequences of non-compliance with its rules, privacy policy or user agreement, NewSigma will provide such notice at least once every three months through the Platform, email, or another appropriate means, in the manner required by applicable law.

Where applicable law requires NewSigma to periodically inform users of its rules and regulations, Privacy Policy, User Agreement or any changes to them, NewSigma will provide such notice at least once every year through the Platform, email, or another appropriate means, in the manner required by applicable law.

Where a statutory requirement differs from these Terms, the applicable statutory requirement will prevail.
